These Affiliate Program Terms & Conditions, the “Agreement”, govern your participation in the Horizum Affiliate Program, the “Program”. By applying to, joining, or participating in the Program, you agree to be bound by this Agreement.
In this Agreement, “Horizum”, “we”, “us”, and “our” refer to gethorizum.com and its owners, operators, successors, and affiliates. “You” and “your” refer to the affiliate applicant or participating affiliate.
1. Purpose of the Program
The purpose of the Program is to allow approved affiliates to promote Horizum products using unique referral links, discount codes, or other approved tracking methods provided by us, and to earn commissions on qualifying sales, subject to this Agreement.
Participation in the Program does not create any employment, agency, partnership, franchise, or joint venture relationship between you and Horizum.
2. Enrollment and Approval
To join the Program, you must submit a complete and accurate application and receive approval from Horizum.
We reserve the right to approve or reject any application at our sole discretion, with or without explanation.
We may reject or remove affiliates whose websites, channels, content, promotional methods, or traffic sources are, in our opinion, unsuitable for the brand, including but not limited to content or activity that:
- is misleading, deceptive, or dishonest
- contains false claims about Horizum or its products
- promotes illegal, hateful, violent, sexually explicit, or defamatory content
- infringes intellectual property rights
- impersonates Horizum or appears to officially represent Horizum
- damages the reputation of Horizum
- violates this Agreement or applicable law
You are responsible for ensuring that all information associated with your affiliate account remains accurate and up to date.
3. Independent Affiliate Status
You are an independent contractor. Nothing in this Agreement creates an employment relationship, partnership, agency, or authority to act on behalf of Horizum.
You may not make statements, guarantees, promises, or representations on our behalf unless we have expressly approved them in writing.
4. Approved Promotion Methods
Affiliates may promote Horizum only through lawful, honest, and brand-safe methods.
Approved promotional methods may include:
- original social media content
- original video content
- blog articles and reviews
- email marketing to lawfully obtained recipients
- other methods expressly approved by Horizum
All promotions must be truthful, non-deceptive, and clearly reflect your genuine experience or opinion where applicable.
You are solely responsible for all content you publish and all promotional activity you undertake.
5. Prohibited Promotion Methods
You may not:
- make false, misleading, exaggerated, or unsubstantiated claims
- impersonate Horizum or suggest that you are Horizum
- create fake accounts, fake reviews, fake comments, fake engagement, or fake traffic
- use spam, unsolicited messaging, automated outreach, or bots
- use malware, adware, forced redirects, cookie stuffing, click injection, or similar tactics
- use deceptive popups, toolbars, browser extensions, or hidden scripts
- use sub-affiliate networks, third-party affiliate pools, or unknown traffic resellers without our prior written approval
- promote Horizum on coupon, cashback, rebate, or deal sites without prior written approval
- offer cashback, rewards, rebates, discounts, donations, or incentives in exchange for using your link or code, unless approved by Horizum in writing
- use your own affiliate link or code for personal purchases
- refer friends, family members, employees, contractors, or businesses controlled by you for the purpose of generating affiliate commissions on purchases you influenced directly
- bid on, target, or otherwise exploit Horizum brand keywords in paid advertising, as described below
6. Strict Paid Advertising Rules
Paid advertising is heavily restricted.
Unless Horizum gives you prior written permission, you may not run paid ads that promote Horizum in any form, including but not limited to:
- Google Ads
- Bing Ads
- YouTube Ads
- Meta Ads
- TikTok Ads
- Native ads
- Display ads
- Retargeting ads
- Shopping ads
- Sponsored placements on search engines or marketplaces
Even where paid advertising is approved, the following rules always apply.
6.1 No Brand Keyword Bidding
You are strictly prohibited from bidding on, targeting, purchasing, or otherwise using any Horizum brand keywords, branded search terms, or confusingly similar variations in paid advertising.
This includes, but is not limited to:
- Horizum
- GetHorizum
- gethorizum
- any misspelling or variation of Horizum
- any combined search phrase containing our brand name
- any branded product queries that include our brand name
- any trademarked or trade name variations associated with Horizum now or in the future
This restriction applies to exact match, phrase match, broad match, broad match modifiers, search themes, Performance Max inputs, competitor targeting overlaps, and any similar targeting mechanism.
6.2 No Brand-Implying Ads
You may not run ads that:
- use Horizum’s brand name in the ad copy, headline, display path, display URL, or creative
- suggest you are the official Horizum website
- mimic our branding, design, tone, or official messaging in a way that confuses users
- direct users to landing pages designed primarily to capture branded traffic intended for Horizum
6.3 No Direct Linking Without Approval
You may not direct link from paid traffic to gethorizum.com using your affiliate link unless Horizum has expressly approved this in writing.
6.4 Legal and Enforcement Rights
Violation of our brand keyword or paid advertising rules is considered a material breach of this Agreement.
In the event of such a breach, Horizum reserves the right to:
- immediately suspend or terminate your affiliate account
- void associated commissions
- withhold unpaid commissions
- reverse previously credited commissions where permitted
- demand removal of infringing ads or content
- pursue legal action or injunctive relief where necessary to protect our brand, trademarks, goodwill, and commercial interests
7. Social Media, Content, and Brand Use
You may only use Horizum brand assets, logos, product photos, videos, or marketing materials that we provide or approve.
You may not:
- modify our brand assets in a misleading way
- use Horizum trademarks in your username, handle, page name, domain name, subdomain, or app name without written approval
- create websites, landing pages, or social accounts that appear to be official Horizum properties
- post content that could reasonably damage the Horizum brand
Horizum may request removal or modification of any content referencing the brand, and you agree to comply promptly.
8. FTC, ASA, and Disclosure Compliance
You are responsible for complying with all applicable advertising, disclosure, consumer protection, privacy, and marketing laws and regulations in your jurisdiction and in the jurisdictions you target.
This includes clearly and conspicuously disclosing your affiliate relationship where required, for example using disclosures such as:
- “This post contains affiliate links”
- “I may earn a commission if you purchase through my link”
- “Paid partnership” or equivalent where legally required
Disclosures must be clear, visible, and not hidden.
9. Tracking and Attribution
Commissions are only payable on sales that are correctly tracked by Horizum’s systems and attributed to your approved affiliate account.
Tracking may rely on cookies, referral links, discount codes, or other systems chosen by Horizum. We do not guarantee uninterrupted tracking and are not liable for technical failures, browser settings, ad blockers, deleted cookies, attribution conflicts, or platform issues that prevent proper tracking.
Horizum’s tracking records and payment calculations are final unless we decide otherwise in our sole discretion.
10. Qualifying Commissions
A commission is only earned on a qualifying sale that:
- is attributed to your approved affiliate account through our tracking system
- is made by a genuine customer
- is fully paid
- is not cancelled, refunded, charged back, fraudulent, self-referred, or otherwise disqualified
- complies with this Agreement and all related policies
Horizum reserves the right to determine whether a sale qualifies for commission.
11. Non-Qualifying Sales
You will not earn commission on any of the following:
- cancelled orders
- refunded orders
- returned orders
- chargebacks
- fraudulent transactions
- duplicate transactions
- test orders
- self-purchases
- orders placed by you on behalf of another person
- orders generated through prohibited traffic sources or prohibited promotional methods
- orders associated with trademark bidding, brand keyword bidding, unauthorized coupon distribution, spam, deceptive practices, or policy violations
- orders where sufficient verification cannot be provided upon request
12. Verification and Audit Rights
Horizum reserves the right to request information at any time to verify your compliance with this Agreement.
This may include, but is not limited to:
- traffic source reports
- Google Ads reports
- Meta Ads reports
- keyword lists
- search term reports
- click reports
- conversion reports
- screenshots
- campaign settings
- landing page URLs
- email creatives
- social media posts
- audience targeting details
- referral methods
You agree to provide requested information within 5 business days, or sooner if reasonably requested.
Failure to provide sufficient information, or provision of incomplete, misleading, or altered information, may result in commission withholding, reversal, suspension, or termination.
13. Commission Rates
Commission rates are determined by Horizum and may be published inside the affiliate dashboard or communicated separately.
Horizum may change commission rates, payout thresholds, product eligibility, promotional exclusions, and incentive structures at any time, at its sole discretion.
Special promotions, temporary rate increases, or custom deals apply only as expressly stated by Horizum in writing.
14. Payment Terms
Approved commissions are paid manually or through a payment method selected by Horizum.
Unless otherwise agreed in writing:
- commissions are only paid after they are reviewed and approved
- commissions are not due until the applicable refund, chargeback, and verification period has passed
- a minimum payout threshold may apply
- payment timing may vary based on verification, payment processor availability, and compliance review
Horizum reserves the right to withhold, delay, offset, or deny commission payments where we suspect:
- policy violations
- trademark bidding
- invalid traffic
- fraud
- abuse
- incomplete verification
- misrepresentation
- disputes about attribution or compliance
If overpayments are made, Horizum may offset them against future payouts or require repayment.
15. Coupon and Discount Code Rules
Affiliates may only promote coupon codes, discount codes, or offers that have been expressly assigned or approved by Horizum.
You may not:
- publish unauthorized codes
- imply a discount exists when it does not
- scrape, guess, leak, or distribute private or single-use codes
- post your affiliate code on public coupon directories, deal forums, browser extensions, cashback sites, or similar channels without written approval
- use “click to reveal” or misleading discount bait tactics
Horizum reserves the right to void commissions arising from unauthorized coupon or discount code activity.
16. Email, SMS, and Direct Messaging
If you use email, SMS, or direct messaging to promote Horizum, you must comply with all applicable laws, including consent, identification, and unsubscribe requirements.
You may not send unsolicited bulk outreach, spam messages, or misleading communications.
You are solely responsible for all compliance obligations related to direct outreach.
17. Intellectual Property
All rights in the Horizum brand, website, products, content, logos, trademarks, images, videos, and marketing materials remain the exclusive property of Horizum.
Your participation in the Program gives you only a limited, revocable, non-exclusive, non-transferable permission to use approved Horizum materials solely for the purpose of participating in the Program in compliance with this Agreement.
We may revoke this permission at any time.
18. Brand Protection and Legal Remedies
You acknowledge that misuse of Horizum’s trademarks, brand terms, or goodwill may cause serious commercial harm.
If you violate this Agreement, especially in relation to:
- trademark use
- brand keyword bidding
- impersonation
- misleading advertising
- unauthorized paid traffic
- deceptive discount distribution
Horizum may seek all available remedies, including suspension, termination, withheld commissions, removal demands, injunctive relief, damages, and legal action where appropriate.
19. Confidentiality
Any non-public information you receive about Horizum, including commission structures, conversion data, internal policies, upcoming launches, creative materials, or business information, must be treated as confidential and may not be disclosed without our prior written consent.
20. Term and Termination
This Agreement begins when you are accepted into the Program and continues until terminated.
Horizum may suspend or terminate your account or this Agreement at any time, with or without notice, and with or without cause.
You may terminate your participation at any time by written notice.
Upon termination:
- you must immediately stop using all affiliate links, codes, and brand assets
- you must remove Horizum promotional materials where requested
- unpaid commissions may be withheld pending review
- commissions related to policy violations are forfeited
Termination does not limit any rights or remedies that accrued before termination.
21. Limitation of Liability
To the fullest extent permitted by law, Horizum will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or opportunity, arising out of or related to the Program or this Agreement.
Horizum’s total liability under this Agreement will not exceed the total commissions paid or payable to you in the 12 months preceding the event giving rise to the claim.
22. No Warranty
The Program is provided on an “as is” and “as available” basis. Horizum makes no warranties, express or implied, regarding the Program, tracking, availability, commission amounts, uninterrupted operation, or fitness for any particular purpose.
We do not guarantee that the Program will always be available, error-free, or profitable.
23. Indemnification
You agree to indemnify, defend, and hold harmless Horizum and its owners, officers, employees, contractors, successors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your participation in the Program
- your breach of this Agreement
- your promotional activities
- your content
- your legal or regulatory non-compliance
- your infringement of any third-party rights
24. Governing Law and Jurisdiction
This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction chosen by Horizum in its official legal policies or company structure.
Any dispute arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts selected by Horizum, unless otherwise required by applicable law.
Important: You should have a lawyer replace this section with the exact jurisdiction you want to use, for example Delaware, the Netherlands, or another jurisdiction that matches your entity and enforcement strategy.
25. Modifications
Horizum may update or modify this Agreement at any time by posting a revised version on gethorizum.com or in the affiliate portal.
Your continued participation in the Program after such update constitutes acceptance of the revised Agreement.
26. Entire Agreement
This Agreement constitutes the entire agreement between you and Horizum regarding the Affiliate Program and supersedes any prior discussions, understandings, or representations relating to the Program.
